GENERAL TERMS AND CONDITIONS – RIAD EMOTION
1. Scope of Application
These general terms and conditions apply to all room rental contracts and to all services provided by Riad Emotion(hereinafter referred to as “the Hotel”) to its guests. Any reservation implies full and unreserved acceptance of these terms.
2. Conclusion of Contract and Reservations

Contract: The contract takes effect upon confirmation of the reservation by the Hotel (in writing or via the Vertical Booking reservation system).

Guarantee: To confirm a reservation, the Hotel reserves the right to request a deposit or a credit card guarantee.

Joint Responsibility: If a third party reserves on behalf of the guest, they are jointly and severally liable with the guest for all contractual obligations.
3. Prices, Payment, and Invoicing

Rates: Prices indicated include legal VAT but may exclude local tourist taxes (Tourism Promotion Tax and Communal Stay Tax), payable on-site.

Adjustment: The Hotel reserves the right to adjust prices in the event of changes in the number of persons, length of stay, or government taxes.

Payment: Unless otherwise agreed, the balance of the stay and extras are payable no later than the day of departure. Invoices without a due date are payable within 10 days.

Currency: Rates are displayed in Moroccan Dirhams (MAD) or Euros (€). Credit card payments in Morocco are processed in Dirhams according to the current exchange rate.
4. Cancellation and No-Show

Cancellation Terms: Cancellation policies depend on the chosen rate (Flexible or Non-Refundable) and are specified at the time of booking.

Late Cancellation: In the absence of specific conditions, any cancellation made less than 7 days before arrival may result in a charge of 100% of the total stay.

Early Departure: In the event of departure before the scheduled date, the full amount of the stay remains due to the Hotel.
5. Occupation and Services

Check-in / Check-out: Rooms are available from 2:00 PM on the day of arrival and must be vacated by 12:00 PMon the day of departure. Late departures may result in the billing of an additional night.

Room Usage: Rooms are strictly reserved for accommodation. Any commercial activity or sub-letting is prohibited without prior written agreement.

Capacity: For security and insurance reasons, the number of persons per room cannot exceed the capacity specified during the reservation.
6. Liability and Security

Valuables: The Hotel declines all responsibility for the loss or theft of items not deposited in the individual safesprovided in the rooms or the central safe at the reception.

Damages: The guest is responsible for any damage caused by themselves or their guests within the Riad and will be billed for necessary repairs or replacements.

Vehicles: As the Riad does not have private parking, parking on public roads or in the Medina’s parking lots is at the guest’s own risk.
7. Data Protection (Law 09-08)
In accordance with Moroccan Law 09-08, Riad Emotion processes your personal data (name, passport, contact details) solely for the management of your stay and legal police obligations.

Confidentiality: Your data is never sold to third parties.

Rights: You have a right to access, rectify, and object to the processing of your data by writing to contact@riademotion.com.

8. Disputes and Applicable Law

Applicable Law: These conditions are exclusively governed by Moroccan Law.

Jurisdiction: In the event of a dispute that cannot be resolved amicably, exclusive jurisdiction is granted to the Courts of Essaouira.
